WALL STREET’S FINANCIAL GESTAPO TO DRAIN BIKER POCKETS
Grapevine, Tx – No one is really sure if it’s the cops or the insurance industry – or both – are behind a blow to letting those who ride decide that was suddenly thrown into the 86th Legislature’s hurdy gurdy goulash by a Dallas lady lawyer who got busted for driving so drunk she genuflected to the cops and told them she loves them, that she will “fight for them.”
As biker activists attended their clubs’ church services on Sunday, January 13, 2019, they took with them the startling news that the Republican Dallas legislator’s proposed H.B. 748 might well unravel all their hard work.
It was “only by chance” that operatives of Texas ABATE and the Legislative Strike Force of U.S. Defenders learned about the bill, said Butch “Popeye” Moss, president of the Sons of Liberty Riders MC.
Representative Victoria Neave, a Democrat who unseated an East Dallas County GOP incumbent in 2016, and promptly got busted for DWI in 2017, has drafted a bill that would repeal Sections 661.003(c), (c-2), and (i) of the Transportation Code.
That law allowed bikers who have completed a rider safety course or have medical coverage approved by the Texas Department of Insurance the option of wearing protective headgear approved by insurance underwriters – or going bareheaded.
If passed by both houses and signed by the Governor, the new rules would put the insurance companies’ government mouthpiece back in charge of the police by repealing the subsection that prohibited an investigative apprehension of riders and passengers riding with no helmet or wearing headgear suspected of not meeting DOT approval, effective September 1 of this year.
This is the specific language that the Neave proposal would repeal:
Sec. 661.003. OFFENSES RELATING TO NOT WEARING PROTECTIVE HEADGEAR. (a) A person commits an offense if the person: (1) operates or rides as a passenger on a motorcycle on a public street or highway; and (2) is not wearing protective headgear that meets safety standards adopted by the department. (b) A person commits an offense if the person carries on a motorcycle on a public street or highway a passenger who is not wearing protective headgear that meets safety standards adopted by the department. (c) It is an exception to the application of Subsection (a) or (b) that at the time the offense was committed, the person required to wear protective headgear was at least 21 years old and had successfully completed a motorcycle operator training and safety course under Chapter 662 or was covered by a health insurance plan providing the person with medical benefits for injuries incurred as a result of an accident while operating or riding on a motorcycle. A peace officer may not arrest a person or issue a citation to a person for a violation of Subsection (a) or (b) if the person required to wear protective headgear is at least 21 years of age and presents evidence sufficient to show that the person required to wear protective headgear has successfully completed a motorcycle operator training and safety course or is covered by a health insurance plan as described by this subsection. (c-1) A peace officer may not stop or detain a person who is the operator of or a passenger on a motorcycle for the sole purpose of determining whether the person has successfully completed the motorcycle operator training and safety course or is covered by a health insurance plan. That would scuttle any progress toward a cessation of police profiling motorists who ride astride two-wheeled beasts plumb out the window – without a parachute.
