DALLAS – There is a holy place – half-remembered, from an old sailor’s dream – that is only revealed in shades of light and shadow, heard in the lipped inflections of a brassy jazz horn, seen in the flutter of bird wings.

There, and sometimes then, now and forever, berobed holy men sell little birds in cages – to penitents – to pilgrims who visit the place in their mind.

Their object is to release the birds on the wind, to watch them fly, struggling up and away from a dead beat into the force of its sudden equalization in gaseous liquidity, to wheel against the sky – and be gone. The coin generated from their capture and sale, their release and the spectacle of their flight, is not taxed, neither is it collected, or accounted.

IT IS WHAT IT IS – IT’S A GAME

CEMENT CITY – THE SINGLETON BOULEVARD BRIDGE – Leading from Cement City in West Dallas, an area so polluted by toxic lead from the smelter and chemicals from the concrete plant that the very soil was scooped up and trucked away to furnaces, is now closed to all but pedestrian traffic. When the protestors came across the bridge in their yellow vests, they were headed to the Dallas Criminal Courts Building, a morbid edifice named for a Mr. Crowley.

It has cascading Aztec steps and a severe aspect flung against the sky in brown brick and mirrored windows.

Inside, according to the yellow vest people, the state prosecuted “victimless, fictitious crimes” for which the punishment far exceeds the severity of the offenses, in their opinion.

Roger Roots of the Fully Informed Jury Association, who served as co-counsel in the federal trial of Mesquite, Nevada rancher Cliven Bundy and one of his sons, addressed the marchers standing beside their Guillotine.

He assisted in the take nothing acquittal verdicts of the Nevada ranchers by insisting that both state and federal Courts are in error when they instruct jurors that the judges are the sole interpreter of the law.

Jury instructions that demand jurors find as fact each and every allegation of complaint enumerated in the charges of the complaint are erroneous, said Mr. Roots.

The only thing a juror who disagrees with the judge’s interpretation and votes for acquittal because he objects to the law need fear is his fear of retaliation.

“No one can second guess you, and you have more power than the Governor. No one can touch a hair on your head without the permission of a jury,” he declared to an approving audience berobed in high visibility safety vests identical to those worn by protesters in Paris and highway construction workers toiling on roads where the iron monsters whiz by a terrifying speeds…

“There have been cases where the defendant freely admitted violation of the law in each and every detail. And still, the jurors voted unanimously for acquittal. There is nothing they can do about it,” he concluded.

The Bundy cases are on point, he explained. In most cases, the judge sustained  prosecution objections to defense questions and introduction of exhibits concerning government snipers training their rifles on the Bundys and their supporters; on the other hand, the Court overruled most defense objections to the admittance to evidence of pictures of protesters standing on bridges with rifles. In any case, the jurors did not hear the arguments concerning the objections while they took place, as they were sequestered.

In private remarks, he explained that his role in trial law is that of a researcher. He scours case law and procedural codes to assist in the defense of accused offenders standing before jury trials.

Roots claims the concept of a jury panel that is completely informed by the law is unassailable, its arbitrary powers of judgment paramount.
